IDJI 120 INSTRUCTION NO. ________ The law requires that your decision be made solely upon the evidence before you. As the sole judges of the facts, you must determine which of the witnesses you believe, what portion of their testimony you accept, and what weight you attach to it. At times during the trial, I may sustain objections to questions asked without permitting the witness to answer, or, where an answer has been made, I may instruct that it be stricken from the record and that you disregard it and dismiss it from your minds. You should not draw any inference from each unanswered question; nor should you consider testimony which has been stricken, in reaching your decision. Such items as I exclude from your consideration will be excluded because they are not legally admissible in a trial. IDJI 120.
