INSTRUCTION NO. ________ At the time of the occurrence in question the defendant (name of carrier) was a common carrier. A common carrier is not a guarantor of the safety of its passengers. But it does have a duty to exercise the highest degree of care, skill and diligence in [receiving] [conveying] [and] [setting down] its passengers as safely as the means of conveyance and circumstances permit. A passenger is a person who with the consent of the carrier [is in the acting of boarding] [is upon] [or] [is in the act of alighting from] the [vehicle] [conveyance] of a common carrier. It was the duty of defendant (name of carrier) to use ordinary care in providing and maintaining in a reasonably safe and suitable condition the facilities it furnishes or invites [its passengers] [individuals preparing to become passengers] [individuals who have just been passengers] [or persons (accompanying) (waiting for) (or) (meeting) passengers] to use.
